  • 4. Description [Abstrak] : Scarborough Shoal consisting of corals and rocks arranged in a circular ring with a circumference of ± 55 kilometers at South China Sea. Scarborough shoal became a disputed area between the Philippines and China which peaked on the 8th of April 2012. The dispute occurred because of double claims between the two countries, where each country has a regulation stating that the region it goes to the territory of the state sovereignty. The absence of a settlement of a scarborough shoal dispute case between the Philippines and China made the Philippines unilaterally resolve the dispute via Permanent Court of Arbitration (PCA) by arbitration process on 22 January 2013. However, China expresses disagreement and non-participation in the process as evidenced by the emergence of China’s Position Paper dated December 7, 2014. The results show that China’s refusal of Scarborough Shoal arbitration filed unilaterally by PCA by the Philippines is through the enactment of article 310 of UNCLOS, the existence of Chinese economic interests and the strategic location of Scarborough Shoal.
